POWERS OF DISQUALIFICATION /CANCELLATION OF DRIVING LICENCES BY COURTS
S.NO.SITUATIONACTION BY COURTU/S M.V.ACT
1 Driver convicted for any offence under M.V.Act May disqualify from driving for a period 20(1)
But if offence u/s 183 (i.e., over speeding) May disqualify from driving for a period only after the offence has been committed for the third time or more Proviso to s.20(1)
2 Driver convicted for an offence for the commission of which a Motor Vehicle was used May disqualify from driving for a period 20(1)
3 Driver convicted for an offence u/s 132 (1) (c) (failure to give name and address on demand when involved in an accident) or u/s 134 (failure to do legally prescribed duty when involved in an accident) SHALL disqualify from driving for a period of one month or more. 20(2)
4 Driver convicted for an offence u/s 185 (Drunken Driving) SHALL disqualify from driving for a period of six months or more. 20(2)
Driver convicted for an offence u/s 185 for the second time SHALL cancel the driving licence 20(2)
5 Driver convicted for an offence u/s 184 (Dangerous Driving) May disqualify from driving for a period & May also direct that the person so disqualified shall have to once again pass the 'Test of Competence to Drive' prescribed by the Licensing Authority to get back his Driving Licence. 20(4)
Driver convicted for an offence u/s 184 for the second time SHALL disqualify from driving for a period less than 5 years UNLESS reasons recorded in writing 20(3)(a)
Case registered against driver having earlier history of conviction u/s184, for causing death/grievous hurt while driving dangerously SHALL disqualify from driving for a period of six months from the date of registration of FIR (Order shall cease to operate if person is discharged/acquitted earlier). 21(1)
SHALL direct that the person has to pass a fresh 'Test of Competence to Drive' & resubmit his 'Medical Fitness Certificate' 22(3)
6 Driver convicted for an offence u/s 189 (Unauthorized racing & trials of speed) SHALL disqualify from driving for a period less than 2 years UNLESS reasons recorded in writing 20(3)(b)
7 Driver convicted for an offence u/s 192 (Using vehicle without registration) SHALL disqualify from driving for a period less than 1 years UNLESS reasons recorded in writing 20(3)(c)
